MASS TORT ADMINISTRATION AND POSTSETTLEMENT ADMINISTRATION
We have been appointed to assist courts and or parties across the country in various roles:
Settlement
- With decades of experience as trial counsel, we bring the necessary experience to facilitate, negotiate, and implement various settlement models tailored to address the parties’ needs and case-specific factual, legal, and practical issues.
- Post-settlement review and evaluation of claims to allocate aggregate settlements among participating claimants using clear, transparent methodologies with appeal rights.
- Allocate EI/EC funds in a fair and equitable manner.
Common Benefit Special Master
- Coordinate with Plaintiff’s leadership to set Common Benefit guidelines and processes for regular, standardized time and expense submission and approval.
- Post-settlement, analyze common benefit submissions to assist in a fair and equitable distribution of common benefit funds among plaintiffs’ counsel.
PRIVATE MEDIATORS
- Mediate individual cases, small groups of cases, inventories, and mass litigations.
- Experience in a variety of types of cases, including product liability, environmental, personal injury, and consumer class actions.
SETTLEMENT COUNSEL
- Evaluate and counsel clients regarding liability risks of complex mass litigation.
- Provide consultation regarding litigation risk mitigation strategies, litigation resolution strategies, and potential settlement structures.
- Craft and implement comprehensive litigation and settlement strategies to achieve client goals for global resolution while remaining flexible given changes in client needs and evolution of litigation landscape.
- Extensive experience negotiating and drafting settlement documentation.
